Kontoinhaber und Verfügungsberechtigung

Die Anzahl der Kontoinhaber ist bei einem Online Gemeinschaftskonto nicht beschränkt. Im Gegensatz zum Einzelkonto mit nur einem Kontoinhaber, sind an einem Gemeinschaftskonto mindestens 2 oder mehr Personen beteiligt. Ein Online Konto für 2 Personen als Girokonto wird meist von Lebenspartnern und Ehepaaren gewählt, aber auch Geschwister können ein Gemeinschaftskonto zu Sparzwecken anlegen.

Das Gemeinschaftskonto unterscheidet sich in zwei Varianten, je nachdem, wie die Verfügungsberechtigung der Kontoinhaber festgelegt ist. Bei einem Gemeinschaftskonto als Oder-Konto können alle Kontoinhaber gleichberechtigt und ohne Zustimmung der anderen über das Konto verfügen. Jeder Einzelne kann Überweisungen tätigen, Bargeld abheben und einzahlen. In diesem Fall erhält jeder Kontoinhaber auch seine eigene Girocard. Dem Abschluss von Kreditverträgen, der Einrichtung von Daueraufträgen und der Kündigung des Kontos müssen aber auch bei einem Oder-Konto alle Kontoinhaber zustimmen.

Beim Und-Konto hingegen können nur alle Kontoinhaber gemeinsam, also mit Zustimmung der anderen, über das Konto verfügen. Das bedeutet, dass für jede Transaktion erst die Genehmigung der anderen mit Unterschrift eingeholt werden muss. Das Und-Konto ist in der Bankenpraxis allerdings weniger verbreitet und kommt meist dann zum Tragen, wenn eine besondere Kontrolle der Finanzen erforderlich ist, z.B. bei Erbengemeinschaften.

Bei beiden Kontovarianten haften alle Kontoinhaber gemeinschaftlich für Schulden, auch die Kontoauflösung kann nur durch alle Kontoinhaber erledigt werden.

Besonderheiten beim Gemeinschaftskonto

Nur Ehepaare können bei einem Online Gemeinschaftskonto mit Zinserträgen einen Freistellungsauftrag stellen. Ein weiterer Aspekt ist die Schenkungssteuer, die unter Umständen von der Finanzbehörde erhoben wird, wenn nur von einem der Kontoinhaber sehr hohe Beträge auf das Konto eingehen.

Ein Gemeinschaftskonto kann nicht als Pfändungsschutzkonto geführt werden. Im Falle eines Pfändungsbeschlusses gegen einen der Kontoinhaber, kann das gesamte Guthaben gepfändet werden, wenn es sich um ein Oder-Konto handelt.

Verstirbt einer der Kontoinhaber und wird das Online Gemeinschaftskonto als Oder-Konto geführt, so treten an dessen Stelle die Erben. Bei einem Und-Konto entsteht im Todesfall eines Kontoinhabers eine wechselseitige Zustimmungsbeziehung zwischen den anderen Kontoinhabern und den Erben. Keiner kann ohne Genehmigung des anderen über das Konto verfügen.

Problematisch kann sich im Erbfall sowie bei Kontoauflösung die Verteilung von Guthaben auf die einzelnen Kontoinhaber gestalten. Daher sollten schon im Vorfeld hierüber schriftliche Vereinbarungen getroffen werden.

Online Gemeinschaftskonto Konditionen

Im Vergleich für ein gemeinschaftliches Online Girokonto kommt es natürlich auf die gleichen Konditionen an wie für ein Einzelkonto, allerdings finden sich auch Konditionen, die bei einem Online Gemeinschaftskonto von besonderer Bedeutung sein können.

Kostenfreiheit in den Punkten Kontoführung, ec Karte, Partnerkarte, Bargeldabhebungen an Geldautomaten im Inland steht an erster Stelle. Unterkonten können bei einem Gemeinschaftskonto sinnvoll sein, was jedoch mit Zusatzkosten verbunden sein kann.
